MIABABY Privacy Policy
This Public Offer Agreement (hereinafter referred to as the “Agreement”) is an official offer of an individual entrepreneur Bohdana Pylypchuk, hereinafter referred to as the “Seller”, to conclude a contract for the purchase and sale of goods remotely with any individual, hereinafter referred to as the “Buyer”, on the terms set out below.

1. General provisions
1.1. This Agreement is a public offer in accordance with Articles 633, 641, 642 of the Civil Code of Ukraine.
1.2. The fact of placing an order on the Site means the Buyer's full and unconditional agreement with the terms of this Agreement.
1.3. The Seller reserves the right to make changes to this Agreement without prior notice to the Buyer. The current version is always posted on the Site.
2. Subject of the contract
2.1. The Seller undertakes to transfer ownership of the goods (children's clothing) presented on the Site to the Buyer, and the Buyer undertakes to pay for and accept such goods under the terms of this Agreement.
2.2. The name, assortment, characteristics, price and description of the goods are posted on the relevant pages of the Site.
3. Ordering
3.1. The Order is placed by the Buyer independently through the Site interface.
3.2. The Buyer undertakes to provide reliable information necessary to fulfill the order:

phone number;

email address;

delivery address.
3.3. The Seller is not responsible for the consequences caused by the Buyer providing inaccurate data.
4. Product price and payment procedure
4.1. Prices for goods are indicated on the Site in the national currency of Ukraine - hryvnia.
4.2. Payment is made cashless through the Portmone payment system using Visa and MasterCard payment cards.
4.3. The Seller does not store or process the Buyer's payment details. All payment transactions are carried out through the secure channels of the Portmone payment system.
5. Delivery of goods
5.1. Delivery of goods is carried out by delivery services throughout Ukraine.
5.2. The delivery time is from 2 to 7 business days from the moment of order confirmation.
5.3. The delivery cost is paid by the Buyer separately, in accordance with the delivery service tariffs.
6. Return and exchange of goods
6.1. The buyer has the right to return or exchange the goods within 14 calendar days from the date of receipt, in accordance with the Law of Ukraine "On Protection of Consumer Rights".
6.2. The goods are subject to return provided that they are in their original condition, consumer properties and have the original packaging.
6.3. Refunds are made via the Portmone payment system to the payment card from which the payment was made, within 5–10 banking days from the moment of receipt of the returned goods.
7. Rights and obligations of the parties
7.1. The Seller undertakes:

process orders in a timely manner;

ensure proper quality of goods;

transfer the goods to the Buyer in accordance with the order.
7.2. The Buyer undertakes:

provide reliable information;

pay for the order on time;

accept the goods.
8. Responsibility of the parties
8.1. The Parties are liable in accordance with the current legislation of Ukraine.
8.2. The Seller is not responsible for delivery delays caused by the work of delivery services or force majeure.
9. Protection of personal data
9.1. Personal data is processed in accordance with the Privacy Policy and current legislation of Ukraine.
9.2. Personal data is used exclusively for the fulfillment of orders and provision of services.
10. Contract validity period
10.1. The Agreement comes into force from the moment of placing the order and is valid until the parties fully fulfill their obligations.
